Dave Kerstein Serves as Panelist at Valcon 2026

On May 6, 2026, Dave Kerstein will serve as a panelist for Valcon 2026, held at the Ritz Carlton in New Orleans. The panel, titled “Hot Topics,” will be moderated by Jackson Toof of ArentFox Schiff and Dave’s fellow panelists include Gordon Novod of Boies Schiller Flexner, Michael Lee and Matt Moran of Vinson & Elkins, and Howard Fischer of Moses & Singer.

The panel focused on:

  • how prediction markets can serve as meaningful valuation inputs by providing market-implied probabilities that may inform and supplement traditional valuation methodologies

  • the ripple effects of valuation in corporate governance, including dividend declarations, unlawful LLC distributions, standing to pursue fiduciary duty claims, receivership appointments, and fraudulent transfer actions—all of which underscore the importance of corporate solvency awareness

  • the powers and authority of a litigation trustee to enter into litigation finance arrangements, including best practices for bankruptcy estates and trustees pursuing such arrangements and the benefits and burdens of litigation finance both generally and in the bankruptcy context, and

  • practical frameworks, recent developments, and key takeaways that valuation professionals, restructuring advisors, and bankruptcy practitioners can apply in their day-to-day practice.
